Welcome to Rose Concierge Senior Services (RCSS)! These Terms and Conditions govern your use of our services. By accessing or using our services, you agree to these Terms. If you do not agree, please do not use our services.
1. Use of Our Services
1.1 Eligibility
You must be at least 18 years old to use our services.
By using RCSS, you confirm that you have the legal capacity to enter into this agreement.
1.2 Permitted Use
You agree to use our services only for lawful purposes and in compliance with all applicable regulations.
You may not misuse our services, including engaging in fraudulent activities, harassment, or unauthorized reselling.
2. Subscription & Payment Terms
2.1 Subscription Plans
Subscription pricing is based on custom quotes, and users must contact RCSS for a personalized service plan.
By subscribing, you agree to automatic renewal unless canceled at least 30 days before the next billing cycle.
2.2 Payments
RCSS currently accepts Zelle, bank transfers, cash, and checks.
All payments must be completed before services are rendered, unless otherwise agreed in writing.
2.3 Cancellations & Refunds
Subscription cancellations must be requested at least 30 days before the next renewal.
Refunds are not available for partially used billing periods.
3. Prohibited Activities
By using RCSS, you agree not to:
Use the services to advertise or sell other goods/services.
Transfer or resell your subscription to another individual.
Provide false information for service requests.
Engage in abusive behavior toward RCSS staff or third-party vendors.
Attempt to disrupt or hack our platform.
4. Limitation of Liability
4.1 General Liability
RCSS shall not be liable for any indirect, incidental, or consequential damages, including financial loss, injury, or business interruption.
Our total liability for any claim shall not exceed the lesser of:
(a) The total amount paid by the user in the past 6 months; or
(b) $1,000.
4.2 Time Limit for Claims
Any claim related to RCSS services must be filed within one (1) year after the issue occurred.
5. Dispute Resolution
5.1 Informal Negotiations
Users must first attempt to resolve disputes by contacting RCSS at rose@rcss.care.
5.2 Arbitration
If unresolved, disputes will be settled through binding arbitration in accordance with [Arbitration Provider] rules.
RCSS agrees to cover excessive arbitration fees, except in cases of frivolous claims.
6. Privacy Policy & Data Protection
Your use of our services is subject to our Privacy Policy [insert link].
RCSS protects user data through encryption and security controls.
Users may contact us to request data access or modifications, but legal record retention laws (e.g., notary records for 7 years) apply.
You can manage your SMS preferences or opt out at any time by replying STOP to any message or contacting us at rose@rcss.care.

7. Changes to These Terms
We may update these Terms periodically. The "Last Updated" date reflects changes. Continued use of our services after updates constitutes acceptance of the revised Terms.
8. SMS Messaging and Consent
By providing your phone number, you consent to receive SMS messages from RCSS regarding appointment confirmations, service updates, and account notifications. Marketing messages will only be sent if you provide separate explicit consent. You may opt out of SMS communications at any time by replying STOP.
